When do you need a Wayleave?

As soon as there is a need to break ground on a road, road reserve or any common/government owned property. A wayleave is most commonly required for all road applications, fibre optic installations, infrastructure installations, and any general excavation or use of common property.

What is a wayleave?

A wayleave is a right of a way granted by the landowner (Private or Government, Provincial &National) for the purpose of carrying out work on the land and road reserve.

Before any work is done on the road reserve, a wayleave must be issued by the Regional Roads Agency wayleave office.

A wayleave will only be approved once all service providers & agencies have responded to the application indicating:

• Proposed work
• Depth of proposed service below road level
• Distance of proposed service from boundary
• Position of all structures including underground
• Extent of underground structures
• A detailed method statement

The purpose of having a wayleave in place before work commences is to ensure that no damage is done to existing infrastructure, Eg excavating where pipes or cables have already been laid.
